National ordinance establishing a new Code of Criminal Procedure (Code of Criminal Procedure) (Parliamentary Year 2018-2019-129)

This draft aims to establish a new Code of Criminal Procedure in connection with legal and technical developments, such as the right of the suspect to consult a counsel before the interrogation (Salduz case law of the European Court of Human Rights), the revision of DNA legislation and the possibility of tele-hearing. The draft also ensures that, pursuant to Article 39, first paragraph, of the Charter for the Kingdom, criminal proceedings in the Netherlands, Aruba Curacao and Sint Maarten are regulated in a similar manner as far as possible.
